The Site is addressed to Almirall employees. This Site is not available to general public. If you do not meet this requirement, please refrain from using the Site.
You represent to us that you do not have any conflict of interest using the Site and that you are not bound by any obligation which prevents you from using the Site.
4. Use of the Site
By adhering to the terms and conditions of this Agreement, you understand that the Site is available for your personal, non-commercial use only, and you agree that you will use the Site only for lawful purposes and in accordance with the Agreement and in full compliance of the applicable laws.
While using this Site you agree, among others:
(i) Keep confidential the user name and the password and not to transmit
them to others, as the case may be.
(ii) Not to access the Site by using another user’s account.
(iii) Not to download, reproduce, change, copy, distribute, sell or

commercial source, or erase or modify any part of the Site or its content,

(v) Not to use this Site for unappropriated, unlawful, fraudulent or

property rights or privacy rights (without being the owner, licensee or
otherwise legally authorized to do so) or which may result in breach of

Without prejudice of any right or legal action that may correspond to us, we reserve the right to prohibit, on a temporary or a permanent basis, your access to the Site in case you breach these Agreement, at our sole criteria and without prior notice.
Intellectual property rights over all the information contained in the Site, graphic designs, logos, drawings, trademarks, images, indices and source codes belong to us, except to those contents belonging to third parties to which you may have access through links and, therefore, all rights are reserved.

The Site contain, or may contain in the future, certain areas where the users can upload and share comments, pictures, videos or other contents (jointly “User content/s”).
By submitting information to us through the website you are representing to us that the User content submitted is not confidential and that, to your best knowledge, your use or the Almirall use of such information is not violating any third party right (including but not limited to intellectual property or privacy rights); in case such User content is not owned by you, such User content will mention source and authorship and will include the copyright notice, as the case may be; and granting us and our affiliates an irrevocable, worldwide, nonexclusive, perpetual, fully sub-licensable, transferable, royalty-free license to use your User Content in the Site and on any other website owned or operated by us or our affiliates.
User Content must be appropriate Should you publish any photographs or videos, you represent and warrant that you have obtained all the necessary permissions.
You acknowledge that the Community contain the opinions and views of other users and that we will not be responsible for the same.

9. Applicable law and jurisdiction
This Agreement shall be interpreted in accordance with the laws of Spain (excluding any rules governing choice of laws) and any legal proceedings arising from this Agreement will take place at the courts of Barcelona city.

You may give us information during your registration process on the Site or whenever you fill in a form which is necessary in addition to such registration and/or when you share content voluntarily on the Site (including, but not limited to name, surname, gender, birth, email, area, country, photograph on Make your Mark).

Your personal data will be used for different purposes as follows:
● To provide you with the services and content to which you may have access through the Site, such as for instance, sending electronic communication strictly related to Make your Mark.
● Part of the data is collected in order to ensure error-free provision of the Site. We might also use the data for analytics about the traffic on our Site.
● Almirall will only process aggregated data and participation statistics on Make your Mark as well as manage the prizes. Your personal data will not be used for any other purposes.

The processing of your personal data for the purposes indicated above is based on your specific consent. If you use the Site without registration and login, the lawfulness lies on the legitimate interest we have to run the Site and the performance of contractual or pre-contractual measures.

The personal data you provide us will be stored and processed until you request to erase your personal data and cancel your account, or until the end of Make your Mark.

Data will not be shared with third parties other than our services providers who help us to better provide you with the services related to the Site. Almirall will only have access to the data in aggregated and statistical form about the use of the Site and in order to be able to deliver the prizes.

You may at any time exercise the following rights in relation to the processing of your personal data by Almirall:
a) Right of access: means the right to obtain access to your information.
b) Right to rectification: means the right to have your information corrected if it is inaccurate or incomplete.
